GDPR Information Clause
INFORMATION CLAUSE ON THE PROCESSING OF PERSONAL DATA
Pursuant to Article 13(1) and 13(2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – “GDPR”), we hereby inform you that:
1. Data Controller
The controller of your personal data is NAJ International Sp. z o.o., Rondo ONZ 1, 00-124 Warsaw, Poland, Tax Identification Number (NIP): 5210090012 (the “Controller”).
2. Purpose and Legal Basis of Processing
Your personal data will be processed for the purpose of conducting recruitment processes carried out by the Controller on behalf of its clients, presenting anonymized candidate profiles to prospective employers, and securing and, where necessary, establishing, pursuing or defending claims related to the recruitment process.
The legal basis for processing your personal data is Article 6(1)(a) GDPR, namely your freely given, specific and informed consent expressed by applying to participate in a recruitment process conducted by the Controller.
Providing personal data is voluntary; however, it is necessary in order to participate in recruitment processes conducted by the Controller.
3. Confidential Recruitment Processes
The Controller conducts recruitment processes within the framework of confidential searches, during the initial stages of which the identity of the prospective employer is not disclosed. Information concerning candidates is presented to prospective employers in an anonymized form that does not allow for direct or indirect identification of candidates.
Personal data enabling your identification will not be disclosed to a prospective employer without your separate and explicit consent.
Should a prospective employer express interest in your profile, you will be informed of the employer’s identity and asked to provide separate consent for the disclosure of your personal data. Upon such disclosure, the prospective employer will become an independent controller of your personal data and will fulfil its information obligations towards you in accordance with Article 14 GDPR.
4. Future Recruitment Processes and Marketing Activities
If you provide separate voluntary consent in the application form, your personal data may also be processed for the following purposes:
· participation in future recruitment processes;
· marketing activities.
The legal basis for such processing is Article 6(1)(a) GDPR.
5. Recipients of Personal Data
Recipients of your personal data may include entities that have entered into recruitment agreements with the Controller, but only after obtaining your written consent.
Your personal data may also be processed by entities providing the Controller with support services in the areas of IT systems, recruitment tools and legal services, solely on the basis of appropriate agreements and in compliance with applicable data protection regulations.
Your personal data will not be transferred to countries outside the European Economic Area unless you are separately informed thereof.
6. Data Retention Period
Your personal data will be retained until the completion of a specific recruitment process or until you withdraw your consent.
Following the completion of the recruitment process, your personal data may be retained for the period covered by your consent to participate in future recruitment processes or, irrespective of the withdrawal of such consent, for the period necessary to establish, pursue or defend potential claims related to your participation in the recruitment process, but no longer than the applicable statutory limitation periods provided for under applicable law.
7. Your Rights
You have the right to:
· access your personal data;
· rectify inaccurate or incomplete data;
· request the erasure of your personal data;
· restrict the processing of your personal data;
· request data portability;
· object to the processing of your personal data;
· withdraw your consent at any time.
Withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
8. Right to Lodge a Complaint
You have the right to lodge a complaint with the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych) if you believe that the processing of your personal data infringes applicable data protection laws.
9. Voluntary Participation and Withdrawal of Consent
Participation in the recruitment process and the provision of personal data are voluntary and constitute consent to the processing of such data. Consent may be withdrawn at any time.
Upon withdrawal of consent, your personal data will be deleted without undue delay. Requests to withdraw consent should be sent to: out@naj.com.pl.
10. Confidentiality and Protection of Client Information
The Controller ensures that personal data and information provided by its clients, including contact details of client representatives, designated contact persons, information concerning recruitment processes, positions, recruitment requirements and any other information provided by clients in connection with cooperation with the Controller, are processed confidentially and protected by appropriate technical and organizational measures.
The Controller safeguards client data against unauthorized access, disclosure, loss, destruction, alteration or unlawful processing.
Access to client data is granted only to persons authorized by the Controller and to entities providing services supporting the Controller’s operations, in particular IT, legal, accounting or administrative services, solely to the extent necessary for the performance of the cooperation and on the basis of appropriate agreements.
11. Updating Personal Data
Changes to personal data may be requested by sending an appropriate request to: RODO@naj.com.pl.
In response, you will receive an activation link enabling you to update your personal data in the Controller’s system.
